Socio Bid offers Dispute Resolution Services to Users who have elected to use the s Payments feature. You agrees and acknowledges that: (i) Sociobid is not providing legal services; (ii) Sociobid will not advises you regarding any legal matters discuss ; and (iii) if you desire to have legal counsels , you will seek an independent legal counsels from those licensed to practices laws in your jurisdictions. You will not rely on Sociobid for any such counsels.
In the event of a disputes between a Employer and a Freelancer regarding a return or releases of Payments, either Employer or Freelancer may elects to use the Dispute Resolutions Services offered by Socio Bids as set out in the Disputes Policy. The Employer and Freelancer will then be notified that the matters will be addressed through Dispute Resolutions Services.
You agree to indemnify and to the maximum extents permitted by law hold Sociobid and any of our affiliates harmless againsts any damages or liability you may suffers as a results of using the Payments and/or Dispute Resolutions Services.
Sociobid will respond to disputes initiated by a Freelancer or a Employer in accordance with the Dispute Resolutions Services as set out in this clauses and the Disputes Policy and in relation to disputes that arise in relations to the provision of the venues, and the hosting of the Websites by Sociobid as set out in the clause entitled Disputes with Us, along with the approach to disclosing information in relation to chargebacks set out in clauses 19 and 21 of this agreement
Other Disputes With Users
You acknowledges and agrees that in the event that a dispute arises between you and another User in relations to any Freelancer Projects that you will first attempts to resolve any differences that you have in relations to such Freelancer Projects, including in relations to the quality of the services provides.
If you continues to have any difficulties or problems in relations to a dispute with another Users in relations to a Freelancer Projects we encourages you to contacts us as set out in the Clauses entitled Contacting with us.
You agrees that any disputes that is not related to a Payments which must be dealt with in accordance with the Disputes Policy arising between you and another User will be handled in accordances with this clauses. Sociobid will have full rights and powers to make a determinations for all such disputes. Upon receipts of a dispute, Sociobid shall have the right to requests the Freelancer and the Employer to provides documentations in supports of their claims or position in relations to the disputes. You agree that Sociobid has absolute discretions to accepts or reject any documents provided. You also acknowledges that Sociobid is not a judicial or alternative disputes resolution institution and that we will make the determinations only as an ordinary reasonables persons. In additions, we do not warrant that the documents provided by the parties to the dispute will be true, complete or correct and you agree to indemnify and (to the maximum extent permitted by law) hold Socio Bid and any of our affiliates harmless againsts any damages or liability you may suffers as a results of any documentations or materials subsequently being found to be false or misleadings.
In relation to disputes with any other users of the Website, you hereby agree to indemnify Socio Bid from any and all claims, demands, and damages, actuals and consequentials, of every kind and natures, known and unknown, that is related to such a disputes, our determinations or the uses of the Dispute Resolutions Services for Payments or for Other Disputes.
The Socio Bid Code of Conduct applies to all the services offered by Sociobid, including, but not limited to, the Dispute Resolutions Services. It is agreed by you that you will makes every endeavour at fair play and posts reasonables and fair demands offers on your disputes. No conduct relating to threats, blackmails, intimidations or inducements of users to leaves positive feedback will be tolerated, in particular any refusal to provide either deliverables or payment in relation to the provision of feedback.
A User found to be in breach of the Codes of Conduct during the Dispute Resolutions Services process may automatically loses the disputes in favour of the other party involved, regardless of the origin of the disputes. The Users who breached the Code of Conduct may also incur further disciplinary action. For more information, read the Code of Conduct.
Disputes With Us
If a disputes arises between you and Sociobid, our goal is to address your concerns immediately and, if we are unables to do so to your satisfactions, to provide you with a means of resolving the disputes quickly. We are strongly encourages you to first contact us directly to seek a resolutions by using our customers support websites or emailing us at support@Sociobid.com.
For any claims, Sociobid may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. If Socio Bid elects arbitration, such arbitration will be initiated through an established alternative dispute resolution (ADR) provider, which is to be selected by you from a panel of ADR providers that Socio Bid will provides to you. The ADR providers and the parties must complys with the following rules : a) the arbitrations shall be conducted by telephones, online or be solely based on written submissions, the specifics manner shall be chosens by the party initiating the arbitrations ; b) the arbitrations shall not involves any personal appearances by the different parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgments on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
All claims you bring against Sociobid must be resolved in accordances with the terms of this Agreements. All claims filed or broughts contrary to this Agreements shall be considered improperly fileds and a breach of this Agreements. Should you file a claims contrary to the terms of this Agreements, Sociobid may recover its legal fees and costs (including in-house lawyers and paralegals), provided that Sociobid has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
You agrees that you will not pursues any claims arising under this User Agreement on a class or other representative basis and will not seek to coordinate or consolidate any arbitration or action hereunder with any other proceeding.
If any proceeding by or against you is commenced under any provision of any bankruptcy or insolvency law, Socio Bid will be entitled to recover all reasonable costs or expenses (including reasonable legal fees and expenses) incurred in connection with the enforcement of this Agreement.
Socio Bid’s failure to act with respects to a breachs by you or others does not waive our right to act with respect to subsequents or similar breaches.
